DANBURY, Conn. — A battle is brewing after the name of a deceased candidate for City Council was left on the ballot in Danbury in Tuesday's election, according to the News-Times.

Gregg Seabury, a Republican incumbent and a candidate for an at-large seat on the Council, died Saturday.

A spokesman for the secretary of the state’s office said it was of "great concern" that Danbury officials were "ignoring Connecticut law," the News-Times said.

Under state law, he said the city was notified that Republicans could either name a replacement for Seabury by 2 p.m Monday or take his name off the ballot, according to the News-Times.

But Republican officials kept Seabury’s name on the ballot, saying they were within the 24-hour window not requiring a replacement because he died on a weekend, according to the News-Times.

If Seabury wins, the party said it would appoint someone to fill the opening, the News-Times said.

Danbury Democrats sent a letter to City Hall threatening legal action if the votes for Seabury are counted, according to the News-Times.
