SHU Student Accused Of Making Up Rape Story Applies For Probation Program

BRIDGEPORT, Conn. — A woman charged with making up a story that she was raped by two football players while they were students at Sacred Heart University in Fairfield has applied for a special probation program, according to the Connecticut Post.

The judge on Wednesday continued the case against Nikki Yovino, 19, of South Setauket, N.Y., who is charged with second-degree falsely reporting an incident and tampering with or fabricating physical evidence, the Post said. Mark Sherman, her lawyer, also applied for accelerated rehabilitation for Yovino on Wednesday, the Post said. 

With accelerated rehabilitation, Yovino would not plead guilty but would be placed on up to two years of probation, after which the charges would be dismissed.

Yovino has also applied for a pretrial diversionary program, contending that she has a psychiatric disability. She must undergo a psychiatric evaluation, then a judge decides whether she suffers a psychiatric disability. If the judge decides that she is eligible for the program, the charges would be dismissed after she completes the program.

The case was continued to Oct. 27.

Last October, Bridgeport Police responded to St. Vincent's Medical Center, where Yovino said she had been raped by two other students, police said. A police investigation determined that she had made up the allegations, and that she had had consensual sex with the two students.

When confronted, Yovino admitted that she made up the story because she did not want to lose another student as a potential boyfriend, according to police.

A lawyer for the two students she accused of rape said they both withdrew from SHU. 

Prosecutors previously offered Yovino a plea bargain of two years in prison in exchange for a guilty plea.
