Judge Blocks Mayor Bloomberg's NYC Ban On Large, Sugary Drinks

NORWALK, Conn. -- A New York State Supreme Court judge Monday invalidated Mayor Michael Bloomberg's planned ban on sugary drinks, which was slated to take effect Tuesday.

Manhattan state Supreme Court Justice Milton Tingling ruled that rules of the law, which was to go into effect Tuesday, are "arbitrary and capricious," applying to only certain beverages and only certain stores, Fox News reported.

Bloomberg continued to defend the ban on Twitter after the ruling.

"Obesity kills more than 5,000 NYers each year. We must take bold steps to fight this crisis," he wrote.

Oh pshaw. My conscious is clear with my statement. I am sure you will find other nefarious threats to our culture that Mayor Bloomberg could have tried to limit as well.

New York City is the best shape it has been in forever. And the safest.

Trying to combat additional causes of cost both physically and financially to its citizenry is a good cause. He's a politician - some of what he floats will go and some won't. Either way, obesity and guns costs in both human lives and in dollars. That other things integral to our culture also do makes this no less true.

Moderation, BTW, in drinking, smoking and driving one's car could save a lot while the effects of guns is irrevocable and obesity takes a lot of effort to reverse. You gave just o.k. examples of the dangers of living in 2013. Do try better.

Big soda's and guns really?
Drinking,Smoking and Automobiles kill far more people a year and cost more in healthcare resources than guns and big gulps do.

If you truly cared about the health and healthcare resources of your country you would be out picketing Budweiser,Philip Morris and GM.

Mayor Bloomberg over stepped his authority but the sheep in NY knew what they were getting when they gave him 2 terms and allowed him to change the law to get a third term,then allowed him to change it back so no one else could seek a third term. Do as I say not as I do.

Both big sodas and guns represent potential private healthcare issues which then can and have become public healthcare problems for which we pay a big price.

Not sure which side to take here. I am guilty of drinking a soda now and then. NOT all the time. But, once in a while Yet, I should probably drink a Perier or something instead

Funny the judge thinks its more important for a citizen to have access to a big soda than a gun. I don't think either are a mayors business.
